Ecuador shrimp: amended U.S. CVD deposits for two exporters
A 14 September 2026 U.S. amendment corrects two calculation errors in the expedited countervailing-duty review of frozen warmwater shrimp from Ecuador. Empacadora del Pacifico rises from 15.17% to 15.18%; Nirsa/Procesadora Posorja rises from 2.21% to 2.23%. Commerce says these amended results change cash deposits for new consumption entries, but are not the basis for assessing duties on the old 2022 entries.
What changed
After its 6 August final results, Commerce accepted two ministerial-error claims: an incorrect figure referenced for Empacadora del Pacifico S.A. and an omitted worksheet revision for Nirsa S.A./Procesadora Posorja S.A. The amended final subsidy rates are 15.18% and 2.23%, respectively, for the 1 January–31 December 2022 expedited review.
Under the cited expedited-review rule, those results do not set assessment rates for that historical period. Commerce instead says it will instruct CBP to collect estimated cash deposits at the amended company rates on covered goods entered, or withdrawn from warehouse, for consumption on or after 14 September 2026.
The timing is based on entry for consumption, not the shipping date. These are corrections to two companies’ rates under an existing order, not a new duty on every Ecuadorian shrimp exporter.
Action Steps for Importers on Amended US CVD Review
- Confirm that the product falls under the existing frozen warmwater shrimp CVD order and match the producer/exporter to Empacadora del Pacifico or the Nirsa/Procesadora Posorja group.
- For covered consumption entries from 14 September 2026, check CBP’s actual deposit instruction and entry summary for 15.18% or 2.23%; do not use the vessel departure date.
- Keep the 2022 expedited-review assessment question separate from new deposits; retain the amended notice and check ACCESS for the underlying calculation memorandum if the rate is disputed.
