US Commerce: Final CVD Results on Oman Aluminum Foil (2023)
The U.S. Department of Commerce published final results of the 2023 countervailing duty (CVD) administrative review for certain aluminum foil from the Sultanate of Oman on 2026-09-15. Commerce found countervailable subsidies for Oman Aluminium Rolling Company SPC (OARC) and assigned a net subsidy rate of 11.38 percent ad valorem for the period January 1–December 31, 2023.
What changed
Commerce concluded its administrative review and determined that OARC received countervailable subsidies during the POR January 1, 2023 through December 31, 2023.
The notice lists the final net countervailable subsidy rate for OARC as 11.38 percent ad valorem, states Commerce will disclose calculations to parties within five days of public announcement or publication, and that Commerce intends to instruct CBP to assess duties and to issue assessment instructions no earlier than 35 days after publication.
The notice also explains cash deposit instructions will be issued for entries on or after the publication date and references reliance on facts available with adverse inferences where applicable.
Three actions for U.S. import operations
- Identify entries of Oman aluminum foil by HTS and producer to determine if OARC-produced shipments are subject to the 11.38% CVD rate.
- Monitor CBP communications for Commerce’s assessment instructions (issued no earlier than 35 days after publication) and prepare for potential assessment on past entries.
- Review internal records for entries entered or withdrawn for consumption on/after 2026-09-15 to calculate cash deposit exposure and update import compliance workflows.
