U.S. suspends de minimis for non-postal imports indefinitely
CBP issued an interim final rule, effective June 24, 2026, that indefinitely suspends the de minimis exemption for merchandise valued at $800 or less arriving by any mode other than the international postal network. These shipments must now use formal or informal entry procedures. Comments on docket USCBP-2026-0760 were due July 24, 2026.
What changed
The rule amends 19 CFR 10.151 to match the suspension that Executive Order 14324 has applied since August 29, 2025 and that E.O. 14388 continued on February 20, 2026. CBP says it acts under its own authority and that the rule does not, in practice, change the existing suspension.
The release-from-manifest process is no longer available for formerly de minimis shipments and the Entry Type 86 test is suspended, which leaves Entry Type 11 as the main informal entry option, with formal entry still possible. The exemptions for bona fide gifts and travelers' personal articles are unchanged.
A statute terminates the de minimis exemption effective July 1, 2027, and a separate rule (2026-12669) covers postal shipments. Any change to this suspension will be announced in the Federal Register.
What an import team should check
- Confirm with your customs broker that every non-postal shipment valued at $800 or less is filed as an Entry Type 11 or formal entry, not released from a manifest.
- Make sure your broker gets the fuller shipment data that an Entry Type 11 requires for low-value orders that used to clear from the manifest with minimal data.
- Set a reminder for July 1, 2027, when the statutory termination takes effect, and watch the Federal Register for a final rule after the comment period on this interim rule.
