U.S. voids importer numbers with inaccurate Form 5106 data
Under Executive Order 14411, CBP is reviewing the CBP Form 5106 data on file for importers of record (IORs). From September 18, 2026, if CBP finds that an IOR or its customs broker gave incomplete or inaccurate information, it will immediately void the IOR number, making it invalid for any purpose, including entering goods, and may take other enforcement action.
What changed
Form 5106 requires the importer name, IRS EIN, SSN or CBP-assigned number, mailing address, physical address if different, phone number and email address, and each item must be accurate and belong directly to the IOR.
The physical address must be the actual location of the business or individual, not a registered agent, customs broker, freight forwarder, P.O. box or business service center. Brokers and third parties may not substitute their own email or phone number.
A broker filing the form needs a valid power of attorney executed directly with the IOR, not through a freight forwarder. CBP will email the basis for voiding to the address the IOR most recently gave, copying the broker that last filed an entry if applicable, with steps to request reestablishment. CBP says separate changes to importer eligibility rules will be announced later.
What an import team should check
- Review the Form 5106 information on file for each IOR number your company uses and confirm the EIN, addresses, phone and email belong directly to your company.
- Replace any registered-agent, broker, forwarder, P.O. box or service-center address, and any broker email or phone number, with your company's own details.
- Confirm your customs broker holds a power of attorney signed directly with your company, and that the email address CBP has on file is monitored for voiding notices.
