CIT judgment amends Dongkuk AD margin on Korean wind towers

The U.S. Department of Commerce published a Timken notice reporting the U.S. Court of International Trade’s September 4, 2026 judgment sustaining Commerce’s remand and amending the 2021–2022 antidumping administrative review margin for Dongkuk S&C Co., Ltd. The notice was published September 16, 2026 and is applicable September 14, 2026.

What changed

Commerce notified the public that the CIT’s final judgment is “not in harmony” with Commerce’s prior Final Results and amended Dongkuk’s weighted-average dumping margin for the August 1, 2021–July 31, 2022 review.

The amended margin for Dongkuk is shown as 1.90 percent (down from 1.95). Commerce states entries produced and exported by Dongkuk for that period remain enjoined from liquidation by CIT order, and that Commerce will not change cash deposit instructions because a superseding cash deposit rate exists.

Immediate actions for importers and brokers

  • Identify Korean wind towers produced and exported by Dongkuk that were entered, or withdrawn from warehouse for consumption, from August 1, 2021 through July 31, 2022; flag the CIT injunction against liquidation.
  • Do not expect revised cash deposit instructions from Commerce; confirm current deposit rate in your internal files and with CBP.
  • Track any appeal and Commerce’s later assessment instructions to CBP; keep the affected entry records ready while liquidation remains enjoined.

This Federal Register notice reports a court judgment and Commerce’s amended final results; it does not itself impose new cash deposit rates or instruct CBP to liquidate entries until a conclusive court decision or further Commerce instruction.
