Final LTFV determination on Indonesian solar cells
The U.S. Department of Commerce published a final affirmative less-than-fair-value determination for crystalline silicon solar cells from Indonesia on September 16, 2026. It lists a 94.36% dumping margin for Blue Sky, REC Solar and all others and says Commerce will instruct CBP to require estimated cash deposits upon publication. A final antidumping duty order still depends on the ITC injury decision.
What changed
Commerce determined that imports of crystalline silicon photovoltaic cells from Indonesia "are being, or are likely to be, sold in the United States at less than fair value (LTFV)." The period of investigation is "July 1, 2024, through June 30, 2025."
Commerce applied adverse facts available (AFA) and "assigned the rate of 94.36 percent to REC Solar." The final weighted-average dumping margins table lists Blue Sky, REC Solar, and "All Others" at "94.36" percent.
Commerce also directed CBP to "continue to suspend liquidation of all entries of solar cells ... which were entered, or withdrawn from warehouse, for consumption 90 days prior to April 28, 2026." The published Federal Register notice states that the determination is applicable September 16, 2026.
Commerce says it will instruct CBP upon publication to require a 94.36% estimated cash deposit for covered entries under the listed producer/exporter categories; importers should confirm the actual CBP instruction.
This deposit stage precedes any final antidumping order, which depends on an affirmative ITC injury determination.
Immediate import operations checks
- Identify covered Indonesian solar-cell consumption entries from the 90-day period before April 28, 2026 and later, and confirm their current suspension and liquidation status with CBP.
- Match the producer and exporter to Blue Sky, REC Solar or all others, then verify the applicable estimated 94.36% cash-deposit instruction with CBP rather than treating it as a final duty assessment.
- Compare your invoices and HTSUS classifications against Appendix I scope language to determine whether products match the covered merchandise or listed exclusions.
