Indonesia solar cells: final CVD rates, order pending

Commerce's September 16 final countervailing-duty (CVD) finding on covered Indonesian solar cells lists 173.70% for PT Blue Sky Solar Indonesia and 73.20% for PT REC Solar Energy Indonesia and all others. It is a final investigation finding, not an issued CVD order. Provisional deposits stopped for entries from June 26; a new order and renewed deposits depend on an affirmative ITC injury decision.

What changed

Commerce changed the preliminary subsidy calculations. Blue Sky's 173.70% estimated rate rests on adverse facts available; REC Solar's calculated 73.20% also sets the all-others rate. Critical circumstances remain affirmative for Blue Sky and all others, but not REC Solar.

The notice describes suspension from November 28, 2025 for Blue Sky and all others, and from February 26, 2026 for REC Solar. Suspension and provisional CVD deposits ceased for new entries from June 26, 2026, while earlier suspended entries remain suspended.

If the ITC finds injury, Commerce would issue an order, reinstate suspension and require deposits at the listed rates; a negative injury finding would end the case and trigger refunds or cancellation.

The written scope includes crystalline-silicon cells at least 20 micrometers thick with a p/n junction, including covered modules and panels, but has detailed thin-film and small/off-grid exclusions. The producing country of the cell matters even when module assembly occurs elsewhere.

The separate Indonesian antidumping finding must be checked independently; the two headline rates do not calculate a shipment's duty.

What an import team should check

  • Compare cell technology, thickness, producing country, module assembly and every relevant Appendix I exclusion against the written scope; do not rely on an HTS code alone.
  • Record the producer/exporter and entry date; distinguish Blue Sky/all-others critical-circumstances entries, REC Solar's February start and the June 26 provisional-measures gap with the broker.
  • Monitor the ITC injury decision and any later Commerce order before applying 173.70% or 73.20% as a new-entry deposit; retain the official notice, CBP instruction and entry evidence.
