India solar cells: final CVD finding, order pending

Commerce made a final affirmative countervailing-duty (CVD) determination on covered crystalline-silicon solar cells from India, published September 16, 2026. Its estimated subsidy rate is 126.09% for two named Mundra companies and all others. This is a final investigation finding, not yet a CVD order: an affirmative ITC injury decision is still required.

What changed

The written scope covers crystalline-silicon cells at least 20 micrometers thick with a p/n junction, including cells assembled into modules, laminates, panels or other products; the appendix lists exclusions for thin-film technologies and specified small or off-grid products.

The 126.09% figure for Mundra Solar Energy and Mundra Solar PV is based on adverse facts available; Commerce also used it for all others. Commerce maintained a critical-circumstances finding for the two Mundra companies, not for all other producers.

The notice describes suspension from November 28, 2025 for those two companies and from February 26, 2026 for others, but says provisional CVD measures ceased for entries from June 26, 2026.

It will reinstate suspension and require deposits only if the ITC makes an affirmative injury finding and Commerce issues an order. The companion antidumping investigation is separate; this rate cannot be added to an AD headline as an entry calculation.

What an import team should check

  • Compare cell technology, thickness, assembly, origin and all relevant appendix exclusions with the written scope; a tariff code or solar-panel label alone is insufficient.
  • Record producer/exporter and entry date, then distinguish the Mundra critical-circumstances period, the February preliminary period and the provisional-measures gap with the broker.
  • Track the ITC injury decision and any later Commerce order before treating 126.09% as a current universal deposit; retain both official notices and entry evidence.
