U.S. amends Mexican light-walled pipe AD rates after CIT ruling

After a final Court of International Trade (CIT) judgment, Commerce amended the 2020–2021 antidumping margins on light-walled rectangular pipe and tube from Mexico: 10.67% for Maquilacero S.A. de C.V. and Tecnicas de Fluidos S.A. de C.V. (TEFLU), reviewed as one entity, and 6.06% for Perfiles LM and Productos Laminados de Monterrey. The notice is applicable September 24, 2026; current cash deposit rates do not change.

What changed

The review covers entries from August 1, 2020 through July 31, 2021. The CIT told Commerce to conform its results to the Federal Circuit's Marmen decision, which found the Cohen's d test unreasonable when the data groups compared are small, not normally distributed and have disparate variances.

Commerce revised its differential pricing analysis in a final redetermination released March 17, 2026, and the CIT sustained it on September 14, 2026 in Consol. Court No. 23-00091. The notice does not restate the margins in the original final results of March 14, 2023, as amended May 12, 2023.

Because all three companies have superseding cash deposit rates from a later review, Commerce will not send CBP revised deposit instructions.

Entries produced and exported by Maquilacero or TEFLU, or produced and/or exported by Perfiles, during the review period remain enjoined during any reconsideration or appeal; if the ruling stands, CBP will assess duties at importer-specific rates and liquidate without antidumping duties where the rate is zero or de minimis.

What an import team should check

  • Check whether your 2020–2021 LWRPT entries from Mexico were produced and exported by Maquilacero or TEFLU, or produced and/or exported by Perfiles LM, since those are the entries the notice says remain enjoined.
  • Ask your customs broker whether any Productos Laminados de Monterrey entries from August 1, 2020 through July 31, 2021 are still unliquidated, as the notice's liquidation section does not name that company.
  • Keep paying the current cash deposit rate on new entries: the notice says Maquilacero/TEFLU, Perfiles and Productos Laminados have superseding rates from a later administrative review.
  • Pull the March 14, 2023 final results, as amended May 12, 2023, to compare the original margins with 10.67% and 6.06% and gauge the possible change in duties if the ruling becomes final.
