U.S. sets preliminary CVD rates on Vietnamese air compressors
Commerce preliminarily found that producers and exporters of stationary and portable air compressors from Vietnam receive countervailable subsidies. Eight listed companies, including Fusheng, TTI (Vietnam) and Tu-Seiki, face a 74.39% rate and all others 37.20%, while Hybest-Vietnam's 0.35% rate is de minimis and liquidation of its entries is not suspended. Cash deposits apply to entries from October 1, 2026. The period of investigation is January 1 through December 31, 2025.
What changed
The 74.39% rate, which the notice marks as based on adverse facts available, applies to Faraday Products Co., Ltd., Fusheng Da Nang Branch (Production & Sales), Fusheng (Vietnam) Industrial Co., Ltd., Jinfeida (Viet Nam) Co., Ltd., Hongkong Sun Rise Trading Limited, TTI (Vietnam), Tu-Seiki Air Compressor Joint Stock Company and Victor Auto Appliance Company Limited.
Because the only individual rates were de minimis or based entirely on facts available, Commerce assigned all other producers and exporters a simple average of the Hybest Vietnam and HK Sunrise rates, listed as 37.20%. The scope covers electric, gas or battery powered reciprocating (piston) compressors of 373 watts to 22.37 kW with an integrated 1 to 80 gallon tank, including unfinished units, kits and units further processed in a third country or the U.S.; rotary and dynamic compressors and tankless inflators of 1 CFM or less are excluded.
Named HTSUS lines are 8414.80.1615, 8414.80.1625, 8414.80.1635 and 8414.80.1685, but the written scope controls. At the request of petitioner MAT Industries, LLC, the final CVD determination is aligned with the companion antidumping final, due no later than February 10, 2027 unless postponed.
Hearing requests are due within 30 days of publication; case briefs, seven days after the last verification report.
What an import team should check
- Match the producer and exporter on each invoice to the rate table: 74.39% for the eight listed companies, 37.20% for all others and no suspension for Hybest-Vietnam; where both have differing rates, the higher applies.
- Ask your customs broker to confirm CVD cash deposits on Vietnamese air compressors entered, or withdrawn from warehouse, for consumption on or after October 1, 2026.
- Compare pump type, tank size, power rating and kit contents with the written scope and HTSUS 8414.80.1615, 8414.80.1625, 8414.80.1635 and 8414.80.1685, including units finished or processed in a third country.
- Diary the aligned final determination, currently due no later than February 10, 2027 unless postponed, and the 30-day window from October 1, 2026 to request a hearing.
