U.S. sets preliminary 92.86% CVD on Malaysian air compressors

Commerce preliminarily found that producers and exporters of stationary and portable air compressors from Malaysia receive countervailable subsidies. Because the examined respondents did not provide the requested information, the five listed companies and all others share one 92.86% rate based on adverse facts available. Cash deposits apply to entries from October 1, 2026; the period of investigation is January 1 through December 31, 2025.

What changed

The 92.86% rate applies to Alton Intelligent Technology Sdn. Bhd., the sole individually examined respondent, and to Panasonic Industrial Device Sales, Puma Air Compressors, Samlin International SDN BHD and Sinppa Industrial SDN BHD.

Because this rate, determined for the non-responsive companies, is the only rate available in the proceeding, Commerce also used it as the all-others rate. Having found the examined respondents uncooperative, Commerce has no calculations to disclose and will not verify.

The scope covers electric, gas or battery powered reciprocating (piston) compressors of 373 watts to 22.37 kW with an integrated 1 to 80 gallon tank, including unfinished units, kits and units further processed in a third country or the U.S.; rotary and dynamic compressors and tankless inflators of 1 CFM or less are excluded.

Named HTSUS lines are 8414.80.1615, 8414.80.1625, 8414.80.1635 and 8414.80.1685, but the written scope controls. At the request of petitioner MAT Industries, LLC, the final CVD determination is aligned with the companion antidumping final, due no later than February 10, 2027 unless postponed.

Non-scope case briefs are due 14 days after publication and hearing requests within 30 days; scope brief deadlines are in the Preliminary Scope Decision Memorandum.

What an import team should check

  • Budget a 92.86% CVD cash deposit on Malaysian air compressors whichever producer or exporter ships them, since every listed company and all others share that rate.
  • Ask your customs broker to confirm deposits are posted on Malaysian air compressors entered, or withdrawn from warehouse, for consumption on or after October 1, 2026.
  • Compare pump type, tank size, power rating and kit contents with the written scope and HTSUS 8414.80.1615, 8414.80.1625, 8414.80.1635 and 8414.80.1685, including units finished or processed in a third country.
  • Diary the case brief deadline 14 days after October 1, 2026 if you plan to comment, and the aligned final determination due by February 10, 2027 unless postponed.

This brief summarizes Commerce's preliminary countervailing duty determination; rates may change in the final. It is not a scope ruling, legal advice or a duty calculation for specific entries. Confirm coverage and deposits with CBP, Commerce or your customs broker.
