U.S. raises Vietnam fish fillet AD rate to $0.20/kg after court

After a final Court of International Trade (CIT) judgment, Commerce raised the 2021–2022 AD margin on certain frozen fish fillets from Vietnam from $0.18/kg to $0.20/kg for Can Tho Import Export Seafood Joint Stock Company (CASEAMEX) and four separate-rate companies. The notice is applicable September 14, 2026; the new rate becomes the cash deposit rate for the four companies, not for CASEAMEX.

What changed

The period of review runs from August 1, 2021 through July 31, 2022. The petitioners, including the Catfish Farmers of America, had alleged a ministerial error in the treatment of marine insurance in CASEAMEX's margin; Commerce rejected it as untimely, but the CIT found that improper.

On remand Commerce accepted the allegation under respectful protest and revised the margin, and the CIT sustained this on September 4, 2026 in Court No. 24-00082.

The $0.20/kg rate also applies to Cafatex Corporation, Hung Vuong Corporation (HVG), International Development and Investment Corporation (IDI) and Loc Kim Chi Seafood Joint Stock Company. CASEAMEX keeps its current cash deposit rate because a later review superseded it.

Entries from the period stay enjoined during any appeal; if the ruling stands, CBP will assess duties at $0.20/kg.

What an import team should check

  • Check the exporter on invoices for Vietnamese fish fillets against CASEAMEX, Cafatex, IDI, Loc Kim Chi and Hung Vuong, including the affiliated companies the notice lists in the Hung Vuong single entity.
  • Ask your customs broker when CBP's revised $0.20/kg cash deposit instructions for Cafatex, HVG, IDI and Loc Kim apply to your entries, and confirm CASEAMEX entries keep their current rate.
  • Budget for possible added duties on enjoined entries from August 1, 2021 through July 31, 2022, since CBP will assess $0.20/kg instead of $0.18/kg if the ruling stands after any appeal.
