India chromium trioxide: 29.35% CVD finding, deposit gap
Commerce's 8 October 2026 final countervailing-duty determination finds a 29.35% subsidy rate for Vishnu Chemicals Limited and all other Indian chromium trioxide producers/exporters in case C-533-945. It does not automatically restart CVD deposits on 8 October. The notice preserves suspension for covered consumption entries from 14 May through 10 September 2026, but says CBP was instructed to discontinue suspension for entries on or after 11 September. Reinstatement and estimated CVD deposits depend on an affirmative final ITC injury decision and a subsequent Commerce order. The finding is distinct from any antidumping proceeding and is not the total duty rate.
What changed
Commerce revised its preliminary calculations for Vishnu Chemicals and the all-others rate; Vishnu Life Sciences Limited is identified as cross-owned with Vishnu Chemicals. The product scope covers chromium trioxide/chromic acid, dry or in solution, irrespective of purity, particle size or form.
Mixtures with substances other than water are included when chromium trioxide is at least 90% of total formula weight, and only that content is covered. Third-country blending, flaking, adding water or packaging does not remove otherwise covered merchandise from scope.
HTSUS 2819.10.0000 and CAS numbers are references; the written description controls. The suspension gap is central to entry planning: do not apply the final 29.35% finding as a new October 8 collection instruction.
A positive ITC result would lead to an order and resumed suspension/deposits; a negative result would terminate the proceeding and refund or cancel the relevant deposits or securities.
Three checks for import teams
- Verify Indian origin, actual producer/exporter, composition, product form and any third-country processing against the written scope rather than the HTS code alone.
- Split your affected consumption entries into 14 May–10 September 2026 and 11 September onward. Ask your broker to reconcile case C-533-945 suspension/deposit treatment with the applicable CBP instructions.
- Track the final ITC injury decision and any CVD order before applying a resumed deposit requirement. Monitor antidumping obligations separately and do not label 29.35% as a combined tariff.
