U.S. raises UAE steel pipe AD margin to 3.64% after CIT ruling

Commerce amended the final results of the 2020–2021 antidumping duty review of circular welded carbon-quality steel pipe from the UAE (December 1, 2020 through November 30, 2021) after an August 19, 2026 Court of International Trade judgment. The margin for Universal Tube and Plastic Industries, THL Tube and Pipe Industries and KHK Scaffolding and Formwork rises from 2.63% to 3.64%. Cash deposit rates do not change.

What changed

Universal appealed the May 2023 final results. The court remanded the case twice, the second time for Commerce to reconsider its differential pricing analysis in line with the Federal Circuit's Marmen opinion, and then sustained Commerce's January 2026 remand redetermination.

Commerce published this notice because the court's final judgment is not in harmony with the original results. A later administrative review has already set a superseding cash deposit rate for Universal, so Commerce will not issue revised cash deposit instructions.

Commerce remains enjoined by court order from liquidating the Universal entries covered by the injunction while any appeal is pending. If the ruling is not appealed, or is upheld by a final and conclusive decision, Commerce intends to have CBP assess duties on Universal's unliquidated entries.

What an import team should check

  • Identify any unliquidated entries of UAE circular welded pipe produced or exported by Universal Tube and Plastic Industries, THL Tube and Pipe Industries or KHK Scaffolding and Formwork from the 2020–2021 review.
  • Ask your customs broker or trade counsel how the amended 3.64% margin could affect assessment of those entries once any appeal ends, since liquidation stays enjoined until then.
  • Keep depositing at Universal's current cash deposit rate on new entries; this notice does not change it because a later review already set a superseding rate.

This brief summarizes Commerce's court-decision notice and amended results for a past review period. It is not a scope ruling, legal advice or a duty calculation for specific entries; confirm liquidation and rates with CBP, Commerce or trade counsel.
